        New Jersey: Possession of ‘High Capacity’ Magazines a Fourth Degree Felony Starting Tuesday

        The possession of “high capacity” magazines will be a fourth degree felony in New Jersey beginning Tuesday morning.

        Gov. Phil Murphy (D) signed the ban on magazines holding over 10 rounds in June, and it takes effect December 11.

        The Conservative Review reports:

        When the clock strikes midnight Tuesday morning, anyone in New Jersey who owns a magazine capable of holding more than 10 rounds of ammunition is officially in possession of illegal contraband and is deemed a fourth-degree felon. Unlike previous magazine bans, this one retroactively bans people from even owning such magazines in their homes, even though they had been purchased legally.

        The ban was challenged in court after it was signed, but last week the United States Court of Appeals for the Third Circuit upheld the ban. Breitbart News reported that a three-judge panel from the Third Circuit voted 2 to 1 to uphold the ban.

        Judge Stephanos Bibas, a Trump appointee, was the panel judge who voted against the ban. He argued that the ruling treats the Second Amendment as protecting second-class rights, unequal with other rights. He wrote, “The Second Amendment is an equal part of the Bill of Rights. We must treat the right to keep and bear arms like other enumerated rights, as the Supreme Court insisted in Heller. We may not water it down and balance it away based on our own sense of wise policy.”

        On a practical note, “high capacity” magazines are not the key element to mass public attacks in America. Rather, the key element is time. Attackers target gun free zones and this gives them time to carry out their evil machinations at their leisure. It creates a scenario where an attacker can pause and reload as much as he likes. Breitbart News reported that the Parkland shooter paused five times to reload during his attack, but unarmed teachers and staff were powerless to intervene.

            That’s the point, it’s all about control. They don’t care about anything else. They want to control every aspect of your life.

            Once they disarm you, then the state has all the firepower and they can and will do whatever they want. To include putting you in a camp or a mass grave.

              Besides the obvious, that many people aren’t even aware of the atrocities that are commonplace in the dark corners of the world, many more people will tell you it can’t happen here.

              Humans are capable of the anything (good and evil). Anything is possible with enough momentum.

                Besides the obvious, that many people aren’t even aware of the atrocities that are commonplace in the dark corners of the world, many more people will tell you it can’t happen here.

                Humans are capable of the anything (good and evil). Anything is possible with enough momentum.

                Too many think of Africa or 2nd-world countries (Yugoslavia, Greece, Turkey). So few even remember the atrocities of 1st world countries – Germany, Spain, US, British territories (South Africa, India), French territories (Libya, Morocco)……then include China, Japan, and Russia……damn now we’re in the 100s of millions, just in the 20th Century….. and most by governments….

                  When people or governments get desperate things can turn brutal fast.

                  Let’s think about contingency planning by our own government.

                  If there aren’t plans available for almost any scenario imaginable then someone isn’t doing their job. I know the military has various contingency plans and I suspect LEA’s do too.

                  What about contingency planning by individuals?

                  Some people have stockpiled supplies from small basics to unimaginably large. There are some prepper types that plan on taking what they need by force.

                  It doesn’t take much to imagine what various gangs and criminals plan.

                  Hell the Weather Underground planned on reeducation and mass murder to deal with us if things had gone according to their plan. They were serious enough about it to conduct terrorist operations right here within the US.

                  Anyone think those types have mellowed their views almost 50 years later?

                  Let’s not forget that some of those pretending to be with us are as evil and authoritarian as any dictator that has ever been in power. Just read some of the lunatics online for proof of this. Particularly those constant fearmongers.

                    coming to a state near you. This is coming to my beloved Virginia. Likely not this January legislative session, but the next. “legislative felon” is the new operative word.

                    I will be curious if they go to an en banc (full court) hearing of the 3rd circuit and how that will pan out. If it follows the 3-judge panel’s ruling, just another confirmation we are already living the WROL situation.

                        Basically for now targeting white dudes who vote GOP, but sooner or later with all progtard initiatives it will be expanded to other enemies of the state.

                        Too bad NJ was literally the home of an actual effective to a certain point militia in America’s break from the tyrants of Albion, the perfidious ones during 1775/1776.

                          Personally I doubt NJ has the balls to take such action!

                          Sure they’ll bust some people on the periphery from random catches, but actively searching out violators?

                          Sure if it happened the majority will go quietly, but it doesn’t take more than a few to make it very costly.

                          The New Jersey State Police corresponded with Breitbart News on December 11 and refused to rule out house-to-house enforcement of the state’s “high capacity” magazine ban.

                          On December 10 Breitbart News reported that New Jersey was hours away from making it a felony to possess a magazine holding more than 10 rounds. The law took effect during the midnight hour of Tuesday, December 11.

                          Breitbart News contacted New Jersey State Police on Monday to ask how they planned to enforce the newly enacted ban. We asked whether they would enforce it on a traffic-stop basis–checking magazines in firearms when they pulled over drivers for speeding, wreckless driving, etc.–or whether they would enforce it by going to house-to-house to check magazine capacity in the firearms New Jersey residents kept in their homes.

                          The basis for the question about house-to-house checks is that Americans always fear Second Amendment prohibitions will lead to knocks on their doors.

                          The NJ State Police refused to rule out house-to-house checks. Rather, they responded: “We do not discuss enforcement strategies.”

                          Breitbart News also reached out to Gov. Phil Murphy’s (D) press secretary Daniel Bryan about enforcement of the ban. As of the publication of this article Bryan had not ruled out house-to-house enforcement of the ban either.

                              Well it’s all talk at this point, so I won’t be pre-judging anyone on what they may do. LEO’s will have to make their call on what they are willing to do when the time comes.

                              Just like I don’t hold all “Lefties” responsible for what the Socialists want to do either. ;-)

                                    The language of the ban clearly exempts officers while on duty or traveling to their duty stations, but that is as far as it goes: “Nothing in subsection a., b., c., d., e., f., j. or k. of this section shall apply to any member of the Armed Forces of the United States or the National Guard, or except as otherwise provided, to any law enforcement officer while actually on duty or traveling to or from an authorized place of duty, provided that his possession of the prohibited weapon or device has been duly authorized under the applicable laws, regulations or military or law enforcement orders.”
